Terms of Use
These Terms of Use ("Terms") govern your purchase and use of Intraday Price Mechanics, including the educational course, ADVISR desktop application, chart plugins, and related materials (collectively, the "Product"). By purchasing or using the Product, you agree to these Terms. If you do not agree, do not use the Product.
ADVISR Intraday Price Mechanics is educational material, and the desktop application presents mathematical outputs derived from market data. Nothing in the Product or in communications from ADVISR constitutes financial advice, investment advice, a trading recommendation, or a solicitation to buy or sell any security or financial instrument. All trading and investment decisions are yours alone. Markets involve risk, and you bear sole responsibility for all trading outcomes.
1. What You're Buying
Your one-time purchase is for access to the ADVISR Intraday Price Mechanics educational course. The ADVISR desktop application and platform plugins are included as optional learning tools. The purchase does not include market data, individualized advice, ongoing support, maintenance, future updates, or a promise that any included software tool will remain available indefinitely.
2. Educational Use and Trading Risk
The Product is provided solely for educational and informational purposes. It is not financial, investment, trading, legal, or tax advice. Markets are uncertain. You are responsible for evaluating the information, making your own decisions, and accepting any resulting gains or losses.
3. No Guarantees
The Product is provided "as is" and "as available". To the maximum extent permitted by applicable law, we make no promises or warranties about trading results, profitability, accuracy, completeness, availability, uninterrupted operation, error-free operation, compatibility, or fitness for a particular purpose. The desktop application may contain bugs, inaccuracies, interruptions, or incomplete data.
4. Ownership and Personal Use
The course, desktop application, written material, images, plugins, and other included content are owned by ADVISR or its creator and are provided for the purchaser's personal use. Purchasing the course does not transfer ownership of the content.
You may not copy, reproduce, publish, upload, distribute, resell, sublicense, share, or make the course, desktop application, plugins, activation credentials, or recovery files available to another person, except where applicable law expressly permits it.
5. Third-Party Data and Services
Included software may connect directly to third-party market-data providers. Their data, availability, terms, and privacy practices are outside our control. Experimental data may be stale, delayed, incomplete, inaccurate, throttled, changed, or unavailable without notice. You are responsible for complying with the terms of any third-party service you choose to use.
6. Payments and Refunds
Freemius acts as merchant of record for purchases from the ADVISR Trading store and handles payment processing, applicable sales taxes and chargebacks. All orders are final and non-cancelable. ADVISR does not offer refunds. Your transaction is also subject to the Freemius EULA and Privacy Policy.
7. Resolving Concerns
If you have a concern, contact [email protected] so we can try to resolve it informally. After a dispute arises, the parties may mutually agree to mediation or another resolution process.
8. Applicable Law
These Terms and any dispute relating to the course or desktop application are subject to applicable law and any mandatory rights available to the purchaser. Nothing in these Terms excludes rights that cannot legally be excluded.
9. Changes to These Terms
We may update these Terms from time to time. When we do, the effective date at the top will change. Updated Terms apply from the date they are posted, subject to applicable law.
